ZERO+1 Caregiver Retreat Liability Waiver Liability Waiver, Release, And Assumption Of RiskThis Liability Waiver, Release, and Assumption of the Risk is entered into between ZERO (“ZERO”) and the Undersigned. In consideration of their participation in the 2025 ZERO+1 Caregiver Retreat, participants acknowledge and agree to the following outlined below. Individuals shall not be able to participate in the Retreat unless this Liability Waiver, Release, and Assumption of the Risk is signed prior to participation.Participation in RetreatThe Retreat is part of the Company’s mission in offering events, programs, and activities to extend and improve the lives of men with prostate cancer. Participation in the Retreat is voluntary and a personal choice. Individuals who choose to participate in the Retreat are responsible for conducting themselves in a safe and reasonable manner and following all safety guidelines as outlined by Retreat organizers or Retreat locations.Retreat Activities and RiskThe Retreat includes travel to Retreat locations. The Retreat also includes a group dinner where alcohol may be offered, served, and/or consumed. Retreat participants will stay for one or more nights in a hotel and will be provided meals throughout the Retreat. The risk of injury and/or illness from the activities involved in the Retreat is significant, including injury, disability, or illness not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, the potential for permanent paralysis, death, or other ailments that could cause serious disability, as a result, for example and without limitation, of slipping, falling, traffic accident or collision, alcohol consumption, and food poisoning. While rules and personal discipline may reduce the risk, the risk of serious injury does exist.COVID-19Those participating in the Retreat understand that COVID-19 is an extremely contagious disease spread mainly through person-to-person contact that can lead to severe illness, disability, and death. There is an inherent risk of exposure to COVID-19 that exists in any place where people are present. The more people a person interacts with, the closer the physical interaction, and the longer that interaction is, the higher the risk of spreading COVID-19.The best way to keep individuals safe is for them to obtain the COVID-19 vaccine which the CDC and FDA have deemed safe and effective, including the FDA’s grant of full approval for at least one of the COVID-19 vaccines. In addition to receiving the vaccine, the CDC and many other public health authorities still recommend and/or require practicing social distancing, mask wearing, staying home if you are ill, and increased hygiene and cleaning practices to prevent the spread of COVID-19.ZERO, following state and local guidance as well as directives from the CDC, has put in place preventative measures to reduce the spread of COVID-19. Participants agree to comply with these preventative measures and any additional health and safety guidelines that may be required, including by any Retreat venue.Participants further acknowledge that ZERO cannot guarantee that individuals will not become infected with COVID-19 and understand that the risk of becoming exposed to and/or infected with COVID-19 may result from the actions, omissions, or negligence of themselves and/or others, including, but not limited to, ZERO employees, subcontractors, and venue agents.Participants voluntarily seek to attend the Retreat and acknowledge that they are increasing their risk to exposure to COVID-19 by doing so. Participants acknowledge that they must comply with all set procedures to reduce the spread of COVID-19 at the Retreat.Participants certify and attest that they will only participate in the Retreat if the below is true before the Retreat begins and throughout the Retreat:They are not experiencing any symptom of illness, including those associated with COVID-19, such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat or new loss of taste or smell.They have not been exposed to someone with a suspected and/or confirmed case of COVID-19.They have not been diagnosed with COVID-19 or, if diagnosed with COVID-19, they have been cleared as noncontagious by state or local public health authorities.They are following all CDC recommended guidelines as much as possible and limiting their exposure to COVID-19.They will follow all COVID-19 safety protocols including wearing a mask if required, maintaining social distance, staying home if sick, and practicing frequent hand hygiene.They will follow directions and protocols communicated by the Retreat staff.Participants willingly agree to comply with the stated and customary terms and conditions for participation. If, however, any participant observes any unusual significant hazard during the Retreat, they will remove themselves from participation and contact terri@zerocancer.org immediately.Acknowledgement and Assumptions of RiskThe Undersigned understands and acknowledges that their participation in the Retreat may involve known or unknown risks of injury or loss due to such things as slips, falls, transportation accidents or collisions, or other accidental or intentional acts arising from the nature of any Retreat event, the condition of the premises, weather or other force of nature, conduct of other individuals, or other expected or unexpected conditions or acts. The Undersigned further understands that participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness, disability, and death does exist. The risk of injury or loss could be minor, but could also be severe, resulting in prolonged medical treatment, permanent disability, or even death. The Undersigned knowingly and freely assumes all risks, known and unknown, foreseeable and unforeseeable, in any way connected with their participation.Release and Waiver of Liability, Acknowledgement, and Assumption of RiskThe Undersigned hereby agrees not to sue, to release from all liability, to indemnify, and agrees to hold harmless ZERO, its parent company, affiliates, and subsidiaries, and each of their employees, contractors, and vendors (collectively, the “Released Parties”) from, and waive on behalf of himself/herself, his/her heirs, and any personal representatives, any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to themself and/or property that may be caused by any act, or failure to act of Company, or that may otherwise arise in any way in connection with the Retreat. The Undersigned understands that this release discharges the Released Parties from any liability or claim that the Undersigned, his/her heirs, or any personal representatives may have against any of the Released Parties with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, the Retreat.The Undersigned affirms and agrees that he/she has read this Liability Waiver, Release, and Assumption of Risk and has had sufficient time to consider it and to consult with an attorney, if desired. The Undersigned further represents and warrants that he/she (a) fully understands the terms of this document, (b) is giving up substantial rights by agreeing to its terms, and (c) is signing freely and voluntarily without any inducement and without any duress or coercion. The Undersigned understands that this Liability Waiver, Release, and Assumption of Risk is a contract with legal and binding consequences and that it applies to all programs, activities, and events connected in any way to the Retreat and engaged in by the Undersigned, regardless of whether or not listed above. The Undersigned agrees to indemnify and hold harmless the Released Parties from any and all claims, demands, causes of action, or liabilities incident to the Undersigned’s involvement or participation in the Retreat, even if arising from the negligence of Released Parties or otherwise.
